Terms of Service

These Terms of Service ("Terms") govern the rental of mobility scooters, electric wheelchairs, strollers, and related accessories (collectively, "Equipment") by Calter LV LLC DBA Scooters Near You ("Company," "we," or "us") to the person completing a booking ("Renter," "you," or "your"). By completing a booking you agree to all provisions below.

Ownership and Condition

All Equipment remains the sole property of the Company. Equipment is delivered clean, charged, and in good working order. You agree to return it in the same condition (ordinary wear and tear excepted) at the end of the rental period or sooner upon our request.

Personal Property Liability

The Company is not responsible for personal items lost, damaged, or stolen while stored in or on the Equipment. You assume all risk and waive any claims against the Company for such loss or damage.

Liability Waiver & Arbitration

You waive any right to sue the Company for injuries, losses, or claims arising from rental or use of the Equipment. All disputes shall be resolved through binding arbitration. Each party shall bear its own legal costs.

Exclusive Use & Non-Transferability

Only the Renter who signs this agreement may operate or permit use of the Equipment. Unauthorized use is strictly prohibited.

Operators & Riders

Primary Renter Age: Must be at least 18 years old. Minor Usage: Minors may operate Equipment only under direct supervision of the Renter, at the Renter's sole risk.

Lightweight Scooter Specifications

Weight capacity: 250 lbs maximum. Battery life is approximately 3–5 hours depending on rider weight, terrain, and driving speed. The Renter is responsible for keeping the scooter charged using the provided cable. If the battery is allowed to fully discharge due to failure to charge, this does not qualify for a refund.

Manufacturer Defects

The Company is not the manufacturer and is not liable for manufacturing or design defects. Suspected defects must be reported immediately.

Equipment Damage, Loss & Theft

You are responsible for all repair or replacement costs. All incidents must be reported within two (2) hours. Card on file will be charged for damage or loss; without a card on file, invoices are due immediately. Unpaid balances beyond 48 hours may be sent to collections or small-claims court under Nevada law. Daily rental rates apply for each day Equipment is unavailable due to damage.

Operation Restrictions

No second riders. No texting or phone use while operating. No off-road use. You assume all liability for misuse except in cases of Company gross negligence.

Third-Party Equipment

If inventory is unavailable, we may fulfill rentals through third-party providers. We assume no liability for Partner-provided Equipment performance. All other Terms apply.

Payment & Identification

We accept Visa, MasterCard, Discover, and American Express. A valid government-issued photo ID matching the cardholder is required at delivery. No cash, prepaid cards, checks, or money orders accepted.

Security Deposit

No deposit required with matching ID. Otherwise, a refundable $200 deposit is required.

Cancellation & Early Return Policy

  • Cancellations 14+ days before delivery: Full refund.
  • Cancellations 7–13 days before delivery: 50% refund.
  • Cancellations less than 7 days before delivery or no-shows: No refund.

Early Returns: If Equipment is returned early for any reason, no refund will be issued for unused rental days. At our discretion, a credit for future rental use may be provided. Refund processing may take up to 30 days.

Late Delivery Guarantee

If delivery is delayed more than one hour, you receive a 50% refund for that rental day.

Protection Plans

  • Basic Plan ($5/day): Covers damage (excludes keys, chargers, baskets). $250 deductible.
  • Plus Plan ($10/day): Covers damage and theft. $250 damage deductible; $500 theft deductible (police report required).

Extensions & Returns

Extensions must be approved before scheduled return time. Unauthorized extensions incur $50 per additional day. Drivers wait 10 minutes past pickup time; after that, a $40 return-trip fee applies.

Battery, Key & Re-Delivery Fees

  • Dead battery re-delivery: $50 (business hours) / $75 (after hours).
  • Lost key replacement: $50.
  • Failure to return charged (8 AM–11 AM returns): $50 fee.

Tracking & Data

GPS tracking may be installed for security purposes. Data may be shared with law enforcement if required.

Fraudulent Chargebacks

We reserve the right to pursue legal action or collections for chargebacks initiated without prior dispute resolution.

Up to 5 SMS messages per month for service updates or promotions. Standard messaging rates apply. Reply STOP to opt out.
